1. Correspondence<\/h3>\n

You must submit the application online (via the\u00a0Environment counter<\/a>). Once you have logged in with DigiD, you will receive a confirmation of dispatch in your inbox.<\/p>\n

The relevant department or local authority will then keep you informed of the progress of your application via the email address you have provided. If you have appointed an authorised representative (e.g. an architect or a building contractor) to handle the application on your behalf, we will communicate with that representative throughout the process. We will send the final planning permission to the authorised representative, but also to the applicant (i.e. you).<\/p>\n

2. Publication request<\/h3>\n

The local authority publishes the planning application on\u00a0officialannouncements.nl<\/a>.<\/p>\n

The local authority advises you to inform your neighbours of your plans so that they are not taken by surprise. Anyone interested may view the application at the local authority.<\/p>\n

When submitting your application, you can indicate whether you object to your personal data being made public. If you choose to do so, it is important to note that we will only anonymise the application form and the decision. If personal data appears on drawings and reports, you are responsible for this yourself. The local authority will not check these documents for personal data.<\/p>\n

3. Time limit<\/h3>\n

The processing period for your licence application begins as soon as you have submitted the application. The acknowledgement of receipt will state which procedure we will use to process your application.<\/p>\n

For standard applications, the decision-making period is 8 weeks.<\/p>\n

The extended procedure is subject to a decision-making period of 6 months. This applies, amongst other things, to applications concerning listed buildings, applications for which an environmental impact assessment (EIA) is mandatory, and amendments to the environmental plan.<\/p>\n

We are permitted to extend the deadline for both the standard and the comprehensive application once, by up to 6 weeks. Should this be the case, we will, of course, inform you accordingly.<\/p>\n

4. Check for completeness<\/h3>\n

The local authority or the relevant department will check whether you have submitted the correct documents (submission requirements). We will also check whether you have applied for the correct activities.<\/p>\n

Once the application is complete, we will process it.<\/p>\n

If anything is missing from your application, you will receive a request to provide further information. This request will specify exactly which documents you still need to submit. It will also state the deadline by which the documents must be submitted. The time you need to provide the documents is not included in the decision-making period.<\/p>\n

5. Processing of the application<\/h3>\n

Once the documents are complete and\/or have been submitted on time, the local authority or the relevant department will process your application.<\/p>\n

If not, the local authority or the relevant department will reject your application, and we will close the case. You will, however, be required to pay the relevant fees.<\/p>\n

6. Assessment<\/h3>\n

The local authority or the relevant department will assess your application against the applicable laws and regulations. These include the environmental plan, the aesthetic guidelines, the structural requirements set out in the Building Regulations (Bbl), the General Local By-law (APV, regarding tree felling and driveways), and the Living Environment Activities Decree. If the plan does not comply with the rules, we will consider whether we can grant an exemption. We will then seek advice from various departments and stakeholders, such as urban planning, cultural heritage, ecology, archaeology and mobility, the VNOG, the GGD and the Environmental Agency. Sometimes we need to seek advice from the council, the water board, the provincial authorities and\/or central government.<\/p>\n

If you receive a negative recommendation following the assessment, you may be able to amend your plan, provided the decision-making period allows for this. This will always be done in consultation with you.<\/p>\n

7. Decision<\/h3>\n

If the assessment results are positive across all areas, you will be granted the licence. A licence may be subject to certain conditions. You are obliged to comply with these conditions. You should therefore read the licence carefully.<\/p>\n

If the advice is negative, and if the plan cannot be amended, we will reject the application. You will, however, be liable for the fees.<\/p>\n

The local authority will publish the decision on\u00a0officialannouncements.nl<\/a>.<\/p>\n

8. Objections and appeals<\/h3>\n

If interested parties wish to lodge an objection (with the local authority), an appeal or an application for interim relief (with the court) against the decision, they may do so up to 6 weeks after the decision has been published.<\/p>\n

9. Validity of the licence<\/h3>\n

A permit remains valid until it is revoked. An exception to this is a permit issued for a specific period; in such cases, the period of validity is clearly stated in the terms and conditions. The local authority may revoke the permit if no work has been carried out after one year. You may also request revocation yourself.<\/p>\n

10. Administrative fees<\/h3>\n

We charge a fee for processing an application. This is set out in the Schedule of Fees under the Fees Regulation. Administrative fees are charged for every application, even if you are not granted a permit. The schedule of fees lists all the fees relating to activities covered by the Environment Act, such as spatial planning activities for building, tree felling, access roads, etc., and technical construction activities. Fees are also charged if we are unable to proceed with your application (for example, due to a failure to submit the required documents) or if the application is refused.<\/p>\n

In some cases, we can only grant a planning permission if we grant an exemption from the rules. For example, if the building plans contravene the rules set out in the environmental plan. We will charge you an additional fee for granting the exemption from the environmental plan.<\/p>\n

If you wish to build a new property or extend an existing one, we calculate the planning fees using the standard cost system. The starting rate is \u20ac431.20. On top of this, there is a fixed amount per square metre of usable floor area. You can work out a rough estimate of the planning fees yourself.\u00a0Please refer to the Schedule of Fees under the Fees Regulation<\/a>.<\/p>\n

11. Commencement of works<\/h3>\n

Once you have received your planning permission, you may usually start work straight away. However, the planning permission is not yet final. After all, an objection may still be lodged within 6 weeks. If no objection has been lodged after 6 weeks, the planning permission becomes final. If you have started work before the planning permission is final, you do so at your own risk. If you have to undo any work as a result of an objection, you will have to bear the costs yourself.<\/p>\n

Permits relating to listed buildings, tree felling, demolition within a protected town or village conservation area, and other permits only come into effect four weeks after the permit has been granted. Please note: objections may still be lodged up to 6 weeks after the permit has been granted. If you commence the works or activities before the permit becomes irrevocable, you do so at your own risk.<\/p>\n

If you are starting the work, you must give at least 2 days\u2019 notice\u00a0register with the local council<\/a>\u00a0quoting the code you are given when the licence is granted.<\/p>\n

In the case of new-build projects (residential or commercial properties), you may only commence construction once the local authority has marked out the building line on the site. You can make an appointment for this by completing the online form via\u00a0the \u2018Marking out the building line\u2019 page<\/a>\u2019.<\/p>\n

12. Connections<\/h3>\n

You can apply for connections to electricity, gas, heating, water, sewerage and media\/communications (such as television, the internet and telephone) via\u00a0mijnaansluiting.nl<\/a>. This is an initiative by various network operators, water companies and suppliers of heating, utilities and communications.<\/p>\n

13. Inspection during construction<\/h3>\n

During construction, the local authority will check that you are complying with the plans for which you were granted the planning permission. You may only carry out the work for which you have been granted the permit (as evidenced by certified documents) and in accordance with the conditions set out. An inspector from the local authority will also visit you once the work has been completed.<\/p>\n

14. House number<\/h3>\n
