Dissolution of a civil partnership

If you both agree and do not have any children, you can dissolve your registered partnership (GP) without going to court. If there are minor children or if one of you wishes to end the partnership, you must dissolve your GP through the courts. Once your RP has been dissolved, you (or your solicitor or notary) must notify your local authority. The dissolution of the RP is only final once it has been registered with the local authority where the partnership was originally registered.

There are two ways to dissolve a registered partnership:

  1. To end a civil partnership without going to court, you will need a solicitor or a notary. Together with the solicitor or notary, you will draw up an agreement stating that you wish to end the civil partnership. You will also make arrangements regarding, for example, spousal maintenance and pension rights. You must submit this agreement to the registrar in the local authority where the partnership is registered.
  2. If you have children who are under the age of majority, or if you are unable to reach an agreement, you should begin the proceedings by having your solicitor submit an application to the court. Once the court has dissolved the civil partnership and the judgement is final, you can have the court’s decision entered in the civil registry of the local authority where the civil partnership was registered.

The agreement (out of court) or court order (through the courts) terminating the partnership must be registered with the civil registry within three months. Your solicitor or notary will send the agreement or order to the registrar. The registrar will record the dissolution in the civil registry.

Once the agreement or order has been entered in the civil registry, the registered partnership is dissolved. The agreement or order will be sent to your home address via your solicitor.
