Compensation claim: loss of income or nuisance

Has the municipality done something or taken a decision that is lawful and you suffer disproportionate damage as a result, for example loss of income or inconvenience? Then you can apply for disadvantage compensation.

People have to accept a certain degree of inconvenience or financial disadvantage as a result of what the municipality does or what the municipality decides. This is called normal social risk. If, compared to others, you suffer disproportionate disadvantage from a lawful act or decision of the municipality, you are eligible for disadvantage compensation.

The award of compensation for loss is subject to these conditions: 

  • you have been disproportionately affected by the decision or action compared to others in a similar position
  • your damage was not foreseeable and falls outside the normal social risk; in the case of loss of income of entrepreneurs, we look, among other things, at the decrease in turnover and/or income on an annual basis
  • the damage is the (direct) consequence of the decision or act
  • there is no insurance, legal arrangement or other provision that compensates for the damage suffered
  • you yourself have done everything reasonably possible to reduce or prevent the adverse consequences

Filing a request for disadvantage compensation costs €300. .

Put in the letter:

  • your name and contact details (address, place of residence, telephone number, e-mail address)
  • which decision or act of the municipality it concerns
  • why you are eligible for loss compensation
  • description of your prejudice (extent and annex(es) with evidence)
  • In case of loss of income from your business:
    • annual accounts for the financial year in which the loss was suffered
    • financial statements of the three previous years, as reference period

This is how it goes after that

You will receive an acknowledgement of receipt.

We assess your request for loss compensation ourselves. Sometimes we set up an advisory committee to decide on the application for loss compensation. In that case, the procedure takes longer.

You will receive a letter telling you whether or not we will grant your request and the reasons why.

We try to process your request within 8 weeks. Sometimes it may take longer, for example if more information is needed for the assessment or if an advisory committee is set up.
