Notification of fire safety compliance – buildings

You need authorisation to ensure the safe use of the highest-risk types of activity. This may apply, for example, to a primary school, a nursery, a care home or a hotel. A notification is also required for the letting of rooms or for a building in which more than 50 visitors may be present at any one time.

A building must always comply with the technical requirements set out in the Building and Living Environment Decree (formerly the Building Decree). This remains in force, even if you have submitted a notification regarding fire safety.

Consider the following situations:

  • There are more than 10 people sleeping in the building (not a residential building, but a commercial or care facility).
  • During the day, there are more than 10 people present who are under 12 years of age, or who have a physical or intellectual disability.
  • There are more than 50 people in a building at any one time (for example, a catering venue).
  • A residential property is used to let rooms to more than four tenants.
  • You are applying the principle of equivalence (technical application).

You can submit the notification via the Omgevingsloket using DigiD or eHerkenning. Search for the term ‘fire safety’ and select ‘safe use of a building in terms of fire safety_notification’. Complete the form and attach the following documents:

  • A site plan (scale 1:500/1:1000) showing the location of the building.
  • A floor plan of the building showing the fire safety markings.

The notification must be submitted at least 4 weeks before you start using the building. It is not part of the planning permission application, but can be submitted via the Omgevingsloket.

The local authority will check that everything is correct and complies with the regulations. If everything is in order, you will receive confirmation. If not, you will need to amend your notification. The local authority may inspect your building as soon as it is in use.

A fire safety compliance certificate is free of charge.
