The municipality assesses which land is eligible for sale. In doing so, the municipality considers, among other things:

  • the green structure;
  • (traffic) safety;
  • possible future developments;
  • logical and straight cadastral boundaries;
  • the presence of cables and/or pipes.

Is the green belt marked as green structure on the map?

In that case, the municipal land cannot be sold. So you do not need to submit an application in that case.

Is the green belt not marked as green structure on the map?

In that case, the municipality can investigate whether the municipal land can be sold. You can submit your application to buy snippet green directly online.

A number of criteria will be taken into account when assessing your application. Sale is not possible if:

  • The green strip forms an important part of the original urban or landscape plan. For example, if the green strip is important for a gradual transition from public greenery to gardens or in guiding cycle paths and footpaths.
  • Banks of water bodies or ditches are no longer accessible for maintenance work by the water board or the municipality.
  • Road safety or social safety leads to deteriorating traffic conditions or the creation of obscure spots and dark corners.
  • Public green space managers can no longer efficiently maintain the land, such as pruning, hoeing and mowing;
  • There are (expected) developments in the neighbourhood in due course where sale of the council land could be an obstacle;
  • This leads to staggered cadastral boundaries and an illogical transition between plot and public area.

After we receive the form, we will assess whether the land can be sold. If the sale can go ahead, we will send you a purchase agreement. If we reject your application, we will notify you.

It is possible that the environment plan at the location you have requested does not allow use as a garden. You will then also need an environmental permit (dispensation for planning-consistent use). We cannot say in advance whether we will cooperate. For more information contact us.

The fixed sales price of €100/m2 applies to strips of land up to and including a surface area of 50 m2. Strips larger than 50 m2 are no longer residual strips in terms of surface area and will be valued on a case-by-case basis by an independent appraiser.

Additional costs

In addition to the purchase price, you will pay buyer's costs. This means that the 10.4% transfer tax on the purchase price and the notary and Land Registry fees will be at your expense.

In addition, an adjustment in the public space may need to be made due to the sale of a piece of land. An example is moving a light pole. We charge the cost of this adjustment to the buyer of the land.

If you are in doubt about the exact location of the plot boundaries (especially the side boundaries) you can via the Land Registry website submit a request for plot boundaries to be marked out on site, for a fee.

You can also go to the Land Registry for a dimensional sketch (fieldwork) of the cadastral plot. This is especially important if you are building your structure near the side boundary of a plot and the accessibility of the (other) plot is at stake.
